Kava Terms of Use

Kava offers a personalized subscription service enabling members to access entertainment via internet-connected devices. The service is provided by Kava Media Corp and its affiliates.
1. Membership
1.1 Your membership continues until terminated. Access requires internet, a compatible device, and a valid payment method. “Payment Method” means any current, accepted payment option, which may be updated. Unless cancelled before billing, you authorize charging the subscription fee for the next cycle.
1.2 Kava offers various subscription plans, including third-party options. The company isn’t responsible for third-party products or services. Different plans may have varying conditions disclosed at sign-up. Account details are available via the “Account” link at kava.tv.
2. Promotional Offers
Kava may offer special promotions like sweepstakes, discounts and incentives. Eligibility is determined at Kava’s sole discretion and offers may be revoked. Existing or recent household members may be ineligible for introductory offers. Kava uses device ID, payment method and contact information to determine eligibility.
3. Billing and Cancellation
3.1 Billing Cycle
Subscription fees and related charges are billed to your payment method on the date shown on your Account page. The billing cycle length depends on your plan type. Payment dates may change if your payment method fails, you change plans, or your subscription began mid-month. Kava may pre-authorize payment methods for up to one month of service.
3.2 Payment Methods
You must provide a payment method. Kava can charge alternate methods if your primary declines. You remain responsible for unpaid amounts. If payment fails and your account remains active, access may be suspended until valid payment is received. Payment issuers may charge fees; local taxes vary by payment method.
3.3 Updating Payment Methods
Update payment information via the Account page. Kava may also update methods using information from payment providers. You authorize continued charges following updates.
3.4 Cancellation
You can cancel anytime and retain access through your current billing period. Payments are non-refundable; no credits are provided for partial periods or unused content. Cancel via the Account page following the cancellation instructions. Your account closes automatically at the period’s end. For third-party payment accounts, cancellation may require action through that provider.
3.5 Price and Plan Changes
Kava may modify subscription plans and pricing. Members receive one month’s notice before changes take effect. You may cancel before changes apply if you disagree.
4. Kava Service
4.1 Members must be at least 18 years old or the age of majority in their jurisdiction. Minors may only use the service under adult supervision.
4.2 The service and content are for personal, non-commercial use within your household only (unless your plan permits otherwise). Kava grants a limited, non-exclusive, non-transferable right to access the service and content. No other rights transfer to you. Public performances are prohibited.
4.3 Content access is primarily within your account’s established country and where Kava offers service and holds licenses. Available content varies by location and changes over time. Simultaneous viewing devices depend on your subscription plan, as shown on the Account page.
4.4 The Kava service and content are regularly updated; availability of particular content isn’t guaranteed. Live events, replays and new features may be offered and may include advertisements and commercial messages. The service may contain branded content, sponsorship messaging and Kava promos. Kava doesn’t endorse advertised products; interactions with advertisers occur at your option and risk. Kava continuously tests service aspects and you can disable test participation via Account settings.
4.5 Some content is available for temporary offline download on supported devices (“Offline Titles”). Limitations apply to quantity per account, maximum devices, viewing timeframes and accessibility duration. Some titles aren’t playable in certain countries; offline titles become unplayable if you’re in a country where streaming isn’t permitted.
4.6 You must use the service in accordance with all applicable laws and regulations. You agree not to:
- archive, reproduce, distribute, modify, display, perform, publish, license, create derivatives from, or use content from the service;
- circumvent, remove, alter, deactivate, degrade, block or thwart content protections, UI elements, advertising, copyrights or trademarks;
- use robots, spiders, scrapers or automated access;
- decompile, reverse engineer or disassemble software or products;
- insert code or manipulate service content;
- use data mining or extraction methods;
- upload, send or transmit material interrupting computer functionality, including viruses or malicious code; or
- engage in these activities in relation to developing, training, testing or validating machine learning tools or systems.
Kava may terminate service for violating these terms or engaging in illegal or fraudulent use.
4.7 Display quality varies by device and factors like location and bandwidth. HD, Ultra HD, HDR and spatial audio availability depend on your internet service and device capabilities. Not all content is available in all formats or for all plans. Minimum speeds: 3.0 Mbps for HD (720p+); 5.0 Mbps recommended for Full HD (1080p+); 15.0 Mbps recommended for Ultra HD (4K+). You’re responsible for internet charges. Startup time varies with location, bandwidth, content and device configuration.
4.8 Kava software is developed by or for Kava and solely authorizes streaming and Kava access through compatible devices. Software varies by device; functionality differs between platforms. Third-party software subject to third-party licenses may be required. You acknowledge automatic receipt of software updates.
5. Passwords and Account Access
You’re responsible for account activity. Allowing others access means they act on your behalf and you’re bound by their changes, including subscription modifications. Maintain device control and don’t share passwords or payment details, to prevent unauthorized access. Provide accurate account information, including valid contact details for notices. Kava may suspend or terminate accounts to prevent identity theft or fraud.
6. Warranties and Limitations on Liability
The Kava service is provided “as is” and without warranty or condition. The service may not be uninterrupted or error-free. You waive special, indirect and consequential damages. These terms don’t limit non-waivable warranties or consumer protections under mandatory local laws.
7. Class Action Waiver
WHERE PERMITTED UNDER THE APPLICABLE LAW, YOU AND KAVA AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER. Courts cannot consolidate claims or oversee representative proceedings (where permitted).
8. Miscellaneous
8.1 Governing Law
These terms are governed by Delaware law and don’t limit consumer protections under mandatory local laws.
8.2 Unsolicited Materials
Kava doesn’t accept unsolicited materials or content ideas and isn’t responsible for similarity to submitted materials.
8.3 Customer Support
Help information is available through kava.tv. Customer Service may use remote-access tools with your consent; if you decline, alternative support is provided. These Terms of Use supersede conflicting Customer Support information.
8.4 Survival
If any provision is invalid or unenforceable, the remaining provisions stay in effect.
8.5 Changes to Terms and Assignment
Kava may modify these terms with one month’s notice for material changes. You may cancel before changes take effect. Kava may assign rights and obligations; you agree to cooperate.
8.6 Events Beyond Control
Service unavailability may result from events beyond reasonable control, including power outages, third-party failures, war, riots, strikes or social unrest. Kava will attempt advance notice but isn’t liable for such events.
8.7 Electronic Communications
Account information (authorizations, invoices, password changes, notices) is sent electronically only.
